Generated Content & Licensing
Effective date: 15 June 2026 · Last updated: 15 June 2026
Summary (not a substitute for reading the full policy)
You own it
Assets generated from your brief belong to you. We assign our rights in unique outputs to you under your active subscription.
Ship it commercially
You may sell, publish, and distribute your game with Fabrik-generated assets — no revenue share, no royalties owed to us.
Do your own clearance
Upstream model providers may have their own license terms. You are responsible for verifying clearance for your specific commercial context.
This Generated Content & Licensing Policy (“Licensing Policy”) explains who owns the assets produced by the Fabrik platform, what rights you have to use them, and how the license terms of the upstream AI models we integrate apply to your use. This Licensing Policy is incorporated by reference into the Fabrik Terms of Service.
We have written this document to give you the clarity you need before shipping a game commercially. If you are a legal professional conducting due diligence, we recommend reading the full policy and contacting legal@fabrik.ai with specific questions.
1. Definitions
For the purposes of this Licensing Policy:
- “Brief” means the creative instructions, descriptions, style references, and uploaded materials you provide to the Fabrik chat interface or API.
- “Generated Content” means any image, symbol, UI element, background artwork, audio clip, music track, voice line, or other asset output produced by the Service in response to your Brief.
- “User Content” means materials you upload to the Service, including reference images, audio files, brand guidelines, and text descriptions.
- “Upstream Model” means any third-party AI model or model provider whose inference capabilities Fabrik uses to produce Generated Content (see Section 6).
- “Commercial Use” means any use of Generated Content in a product, service, or work that is sold, licensed, publicly distributed, or monetized in any way, including games released on app stores, game platforms, or direct channels.
2. Ownership of Your Brief and User Content
You retain full ownership of your Briefs and any User Content you upload to Fabrik. Nothing in these Terms or this Licensing Policy transfers ownership of your original creative direction, brand assets, or reference materials to Fabrik.
By uploading User Content, you grant Fabrik a limited, non-exclusive, royalty-free license to use, reproduce, and process your User Content solely as necessary to provide the Service to you (i.e., to generate the assets you requested). This license terminates when you delete the relevant content or close your account, subject to backup retention periods described in our Privacy Policy.
3. Ownership of Generated Content
3.1 Assignment of Rights
To the maximum extent permitted by applicable law and subject to the conditions in this Section 3, Fabrik assigns to you all of Fabrik’s rights, title, and interest in the Generated Content produced in response to your Brief. This assignment is effective upon generation and is included in the cost of your active subscription — there are no additional fees or royalties owed to Fabrik for Commercial Use of Generated Content.
3.2 Conditions for Assignment
The assignment in Section 3.1 is conditional on:
- Your account being in good standing (not suspended or terminated) at the time of generation;
- Your use of the Service being in compliance with the Terms of Service and the Acceptable Use Policy; and
- Your compliance with any applicable Upstream Model license terms described in Section 6 of this policy.
If any condition is not met, Fabrik does not assign rights in the relevant Generated Content, and your use of that content may constitute infringement.
3.3 Free Plan Restrictions
Generated Content produced under the Free (non-paid) subscription tier is licensed to you for non-commercial use only— you may use it for personal projects, portfolios, internal prototyping, and game-jam submissions that generate no revenue. To use Generated Content commercially, you must be on a paid subscription plan (Pro, Studio, or Enterprise) at the time of generation.
3.4 No Exclusivity
Because AI generation is non-deterministic, Fabrik cannot guarantee that the same or a substantially similar output will not be generated for another user in response to a different prompt. We do not grant exclusivity in Generated Content. If exclusivity is critical to your project, you should treat Generated Content as a starting point and apply sufficient additional creative work to create a distinguishable final asset.
3.5 Copyright in AI-Generated Works
Copyright law regarding AI-generated content continues to evolve globally. In many jurisdictions — including the United States as of the date of this policy — AI-generated works without sufficient human creative authorship may not qualify for copyright protection. Where copyright subsists in your Generated Content (due to your creative contribution through the Brief, selections made during the review process, or edits applied), that copyright belongs to you per the assignment in Section 3.1. Fabrik makes no warranty that Generated Content qualifies for copyright protection in your jurisdiction.
4. What You Can Do with Generated Content
Subject to the conditions in Section 3.2 and the plan restrictions in Section 3.3, you may:
- Include Generated Content in games and interactive media that you distribute commercially, including games sold on Steam, the App Store, Google Play, console platforms, or browser-based platforms;
- Use Generated Content in marketing materials, trailers, screenshots, and promotional assets for your game;
- Modify, adapt, composite, and derive from Generated Content without restriction from Fabrik;
- License your finished game (which incorporates Generated Content) to publishers, platforms, or end users on any terms you choose;
- Register copyright in your finished work as a whole (including Generated Content components where sufficient human authorship is present) in jurisdictions where such registration is available; and
- Retain and archive Generated Content for the life of your project, even after your Fabrik subscription lapses, provided the content was generated during an active paid subscription.
5. What You Cannot Do
You may not:
- Sell, license, or distribute Generated Content as standalone stock assetsoutside of a finished game or interactive product (e.g., listing Fabrik-generated sprites on a stock-asset marketplace) without upgrading to an Enterprise plan with a separate stock-asset licensing addendum;
- Claim that Generated Content was created by human artists without disclosure, in contexts where such misrepresentation would be deceptive to end consumers or violate applicable advertising or platform disclosure requirements;
- Use Generated Content in a manner that violates the Acceptable Use Policy; or
- Sub-license or re-sell Generated Content as a product that competes with the Fabrik platform itself.
6. Upstream AI Model Licenses
Fabrik uses multiple upstream AI model providers to generate content across different asset categories (image, audio, voice, etc.). The license terms of these Upstream Models may affect your rights in Generated Content. Below we summarize the key points; however, you should review the upstream providers’ own terms before relying on this summary for legal decisions.
6.1 General Upstream Model Principles
Most Upstream Models Fabrik integrates operate under one of these license structures:
- Commercial-permissive: The model provider allows commercial use of outputs without restriction, provided you comply with their usage policies (which typically mirror our AUP). The majority of models Fabrik currently integrates fall into this category.
- Commercial-permissive with attribution requirement: Commercial use is permitted but the provider requires disclosure that AI tools were used in production. Where this applies, we will surface a disclosure notice within the Fabrik export bundle.
- Research/non-commercial only:Some experimental model capabilities may be gated behind a non-commercial-only model. Fabrik will clearly label generation features powered by non-commercial models as “Non-commercial output.” You may use such outputs for internal prototyping and non-revenue-generating purposes only.
6.2 Audio and Music Models
AI music generation operates in a particularly dynamic legal and licensing environment. The models Fabrik integrates for music and SFX generation are selected to offer commercial-permissive output licenses. However:
- Generated music does not include a sync license for third-party copyrighted musical works. If your Brief requests generation “in the style of” a specific existing composition, the resulting audio will be stylistically influenced but is not a reproduction of, and does not license, the source work.
- Fabrik does not guarantee that generated audio output is free from claims by performing rights organizations (PROs) or sound recording right holders. You are responsible for any necessary music licensing for your distribution channels (e.g., streaming platforms with Content ID systems).
- For iGaming and casino titles, consider whether the jurisdiction requires disclosure that game audio was AI-generated.
6.3 Voice and Speech Models
Generated voice lines are produced by text-to-speech and voice synthesis models. You may use generated voice lines commercially within the same terms as other Generated Content. Restrictions:
- Do not instruct the Service to generate voice output in a manner intended to clone or impersonate a specific real person’s voice without their consent; and
- Generated voice output must not be used in automated calling systems, political advertising, or other contexts where AI voice impersonation raises specific regulatory concerns in your jurisdiction.
6.4 Model Disclosure Documentation
Fabrik maintains an internal register of the Upstream Models used for each asset category. Enterprise customers may request a copy of the current model disclosure documentation, including the applicable license terms, by contacting legal@fabrik.ai. We update this documentation when we add or change model providers.
7. Indemnification and Your Clearance Responsibility
Fabrik provides the generation infrastructure and assigns its rights in Generated Content to you. However, Fabrik does not indemnify you against third-party intellectual property claims arising from your use of Generated Content, including claims that Generated Content infringes a third-party copyright, trademark, right of publicity, or other intellectual property right.
You are responsible for:
- Conducting your own legal review of Generated Content before commercial use, including any necessary freedom-to-operate analysis;
- Ensuring that your Brief and any uploaded reference materials do not instruct Fabrik to reproduce third-party protected works; and
- Consulting with a qualified intellectual property attorney in your jurisdiction before making significant commercial commitments based on Generated Content.
You agree to defend, indemnify, and hold harmless Fabrik from any third-party claims arising from your use of Generated Content or your distribution of products incorporating Generated Content.
8. Enterprise and Custom Licensing
Enterprise customers may negotiate:
- Stock-asset sublicensing rights— permission to distribute Generated Content as standalone assets outside of finished games;
- Expanded indemnification— limited IP indemnity coverage for Generated Content, subject to defined caps and exclusions;
- Data isolation— contractual commitment that your project data and Generated Content are not used in any form for Fabrik platform improvement; and
- Model transparency reports— detailed disclosure of which models generated which asset category on your account, for audit purposes.
To discuss Enterprise licensing options, contact enterprise@fabrik.ai.
9. Fabrik Platform IP
Nothing in this Licensing Policy grants you any rights in the Fabrik platform itself, including our software, UI, agent system, orchestration logic, APIs, brand assets, or documentation. All such materials remain the exclusive property of Fabrik AI, Inc.
10. Changes to This Policy
We may update this Licensing Policy from time to time, particularly as AI copyright law develops and as we integrate new Upstream Models. We will notify you of material changes by email or prominent in-app notice at least 14 days before they take effect. Changes that would reduce your rights in Generated Content will not apply retroactively to assets already generated under a prior version of this policy.
